Whitmer Kidnap Judge: Defense Can’t Cite FBI Entrapment Efforts

Posted by M. C. on August 29, 2023

‘When you said [FBI informant] Dan is the one who did the training, that is describing the FBI as entrapping your client…’

For instance, at his federal trials last year, Fox was prohibited from introducing as evidence thousands of text messages between FBI informants and their handling agents. Those texts show, among other things, that FBI agents encouraged their informants to kidnap Whitmer.

What do the arresting entrapment agents, the prosecutor and judge have in common? They all work for the same boss.

(Ken Silva, Headline USA) During Tuesday’s opening statements at the trial of three men accused of aiding the 2020 alleged militia plot to kidnap Michigan Gov. Gretchen Whitmer, defense attorney Bill Barnett made accurate statements about an FBI informant involved in the case—describing how the informant, Dan Chappel, became the second in command of a militia, trained his fellow members and encouraged them to commit crimes.

State prosecutor Bill Rollstin objected to Barnett’s factual statements, accusing him of trying to “poison the jury” by arguing that the FBI entrapped his client.

Barnett responded to Rollstin’s claim by arguing that he’s only presenting true facts to the jury.

“I was stating facts that are in the police reports. Everything’s a fact. They don’t want to hear facts in this case,” he said.

Barnett further said that he’s not even arguing that his client, Eric Molitor, was entrapped. Barnett said Molitor didn’t have anything to do with the kidnapping conspiracy and is innocent of any wrongdoing.

“I never once said, ‘entrapment,’” the lawyer said. “I’m sorry I had to tell the whole story that’s not being told here [about FBI informants provoking the plot].”

However, Judge Charles Hamlyn agreed with the prosecution. The judge claimed that by noting that an FBI informant was second in command of a militia supposedly plotting to kidnap Whitmer, Barnett was essentially making an entrapment defense.

“There were a couple times you said the FBI did the training, the FBI was the XO [executive officer], [confidential human source] Dan was the one to organize these guys and did that,” the judge said.

“If you didn’t cross the line, you were right on it,” he added.

“When you said CHS Dan is the one who did the training, that is describing the FBI as entrapping your client.”

The judge’s ruling sparked outrage from those watching the trial, including from the sister of Adam Fox, one of the men who was found guilty last year of plotting against Whitmer.

Fake terror plots, paid informants: the tactics of FBI ‘entrapment’ questioned | FBI | The Guardian

Posted by M. C. on July 14, 2021

Even more shocking was that the organisation, money, weapons and motivation for this plot did not come from real Islamic terrorists. It came from the FBI, and an informant paid to pose as a terrorist mastermind paying big bucks for help in carrying out an attack. For McWilliams, her own government had actually cajoled and paid her beloved nephew into being a terrorist, created a fake plot and then jailed him for it. “I feel like I am in the Twilight Zone,” she told the Guardian.

Critics say bureau is running a sting operation across America, targeting vulnerable people by luring them into fake terror plots

David Williams did not have an easy life. He moved to Newburgh, a gritty, impoverished town on the banks of the Hudson an hour or so north of New York, at just 10 years old. For a young, black American boy with a father in jail, trouble was everywhere.

Williams also made bad choices. He ended up going to jail for dealing drugs. When he came out in 2007 he tried to go straight, but money was tight and his brother, Lord, needed cash for a liver transplant. Life is hard in Newburgh if you are poor, have a drug rap and need cash quickly.

His aunt, Alicia McWilliams, was honest about the tough streets her nephew was dealing with. “Newburgh is a hard place,” she said. So it was perhaps no surprise that in May, 2009, David Williams was arrested again and hit with a 25-year jail sentence. But it was not for drugs offences. Or any other common crime. Instead Williams and three other struggling local men beset by drug, criminal and mental health issues were convicted of an Islamic terrorist plot to blow up Jewish synagogues and shoot down military jets with missiles.

Lawyers for the so-called Newburgh Four have now launched an appeal that will be held early next year. Advocates hope the case offers the best chance of exposing the issue of FBI “entrapment” in terror cases. “We have as close to a legal entrapment case as I have ever seen,” said Susanne Brody, who represents another Newburgh defendant, Onta Williams.

Some experts agree. “The target, the motive, the ideology and the plot were all led by the FBI,” said Karen Greenberg, a law professor at Fordham University in New York, who specialises in studying the new FBI tactics.

ICE arrests 90 more foreign students at fake university created by DHS in Michigan

Posted by M. C. on November 29, 2019

Fake criminals, fake crimes all to make fake law enforcement look like they are doing something. And making a few bucks off the victims.

Gives them something to do when they are not trying to depose a sitting US president.

DETROIT – About 90 additional foreign students at a fake university in metro Detroit created by the Department of Homeland Security have been arrested in recent months.

A total of about 250 students have now been arrested since January on immigration violations by U.S. Immigration and Customs Enforcement as part of a sting operation by federal agents who enticed foreign-born students, mostly from India, to attend the school that marketed itself as offering graduate programs in technology and computer studies, according to ICE officials.

Many of those arrested have been deported, while others are contesting their removals. One has been allowed to stay after being granted lawful permanent resident status by an immigration judge.

The students had arrived legally in the U.S. on student visas, but since the University of Farmington was later revealed to be a creation of federal agents, they lost their immigration status after it was shut down in January. The school was staffed with undercover agents posing as university officials.

Out of the approximately 250 students arrested on administrative charges, “nearly 80% were granted voluntary departure and departed the United States,” the Detroit office of ICE’s Homeland Security Investigations told the Free Press in a statement Tuesday.

Of the remaining 20%, about half have received a final order of removal; some were ordered removed by an immigration judge, and others “were given an expedited removal by U.S. Customs and Border Protection,” HSI Detroit said.

The remaining 10% “have either filed for some sort of relief or are contesting their removals with Executive Office for Immigration Review,” HSI Detroit said.

ICE said in March that 161 students had been arrested, a number that has now grown to about 250.

Meanwhile, seven of the eight recruiters who were criminally charged with trying to recruit students have pleaded guilty and been sentenced in Detroit. The remaining defendant  will be sentenced in January.

Attorneys for the students arrested said that they were unfairly trapped by the U.S. government since the Department of Homeland Security had said on its website that the university was legitimate. An accreditation agency that was working with the U.S. on its sting operation also listed the university as legitimate.

Fake university believed to have collected millions of dollars

There were more than 600 students enrolled at the university, which was created a few years ago by federal law enforcement officials with ICE. Records filed with the state Department of Licensing and Regulatory Affairs show that the University of Farmington was incorporated in January 2016.

Many of the students had enrolled with the university through a program known as Curricular Practical Training, which allows students to work in the U.S through a F-1 visa program for foreign students. Some had transferred to the University of Farmington from other schools that had lost accreditation, which means they would no longer be allowed to remain in the U.S….

Forgotten FBI Anti-Terrorism Entrapment Debacles – James Bovard

Posted by M. C. on October 18, 2018

A Justice Department inquiry found that prosecutors failed to turn over more than 100 documents to defense attorneys during the trial, including a letter written by a convict who served time with Hmimissa that stated that the star witness had bragged about “how he lied to the FBI” on the terror-cell case

The owner of the limousine company that killed 20 people in New York last weekend was an FBI informant who helped carry out two big entrapment operations against Muslims after 9/11. Prior to being recruited by the FBI, he was caught helping people cheat on DMV tests.  Before that, he was arrested for murder in Pakistan but escaped after someone bribed police.  FBI officially permits its informants to commit 5000+ crimes a year. But running an illegal limousine service that kills 20 people was probably not pre-approved. Actually, the FBI provided luxury cars to help get this business started in 2008.

Here’s a piece I did 14 years ago on FBI and Justice Department entrapment and other debacles in the first years of the War on Terror.

On May 7, the FBI arrested Brandon Mayfield, an Oregon lawyer, for his alleged involvement in the Madrid train bombings of March 11 that killed 191 and left 2,000 wounded. A U.S. counterterrorism official (almost certainly an FBI or Justice Department official) told Newsweek that Mayfield’s fingerprint was an “absolutely incontrovertible match” to a copy of the fingerprint found on a bag of bomb detonators near the scene of the Madrid attack. News of Mayfield’s arrest provided alarming evidence that Americans were involved in international conspiracies to slaughter civilians around the globe, and he was informed that he could face the death penalty for his crimes.
