A HUGE win for free speech

Two new developments were not covered by any mainstream media, so I thought I’d let you know about them. You aren’t supposed to know this but …

This news article in the Epoch Times announcing that a free speech case brought by two state attorney generals is a big deal.

And today there is now this headline that subpoenas have been served and the officials (as well as Twitter, YouTube, Meta, Instagram and LinkedIn) have 30 days to respond:

You will not find either story in mainstream media because it is counter narrative. But for people like me, this is one of the biggest news items I’ve seen.

Alex Berenson tried to argue the state-action doctrine in his Twitter lawsuit, but Judge Alsup denied it. This was in Federal Court in San Francisco.

See this excellent article (and it’s short) describing the state-action doctrine. It notes that federal courts think Twitter is off the hook, but state courts can rule differently.

I’m looking at suing Twitter in California state court and if I win, Twitter has to pay my legal expenses and it also means they can’t silence free speech on their platform anymore, which will be a huge step forward for free speech.

This development is a big win because it means that a judge wasn’t convinced by the government’s attempts to dismiss the case. If the case succeeds, it could open up free speech on all these platforms. It would mean that people with vaccine injuries don’t have to hide anymore.

This win in court is more evidence that the narrative will be falling apart soon.

I now have nearly 100 reasons the safe and effective narrative is falling apart.

Summary

Free speech is key.

This ruling and the issuance of subpoenas is a solid step in restoring free speech rights on social media platforms.

The decision makers aren’t hearing the other side of the story because voices have been censored, including the voices of millions of vaccine injured people.

As I’ve said before, the key to ending the pandemic is for decision-makers to start listening to the people that are being censored.

So stopping censorship is an important step forward.

Once that happens, we can go back to normal almost instantly since COVID will no longer kill nearly as many people (we’ll use sensible treatment for in-patient and out-patients), the PCR and antigen tests will be properly specified to eliminate the false positives, and we can end all the stupid mitigation measures (like masks, lockdowns, isolation, etc). And we’ll start incentivizing hospitals to save lives instead of killing people. With a handful of changes, I think there’s an excellent chance we can cut the death rate from COVID to insignificant levels.

It is particularly symbolic that in the midst of this imbroglio, the FBI just accidentally revealed the name of another Saudi embassy official complicit in the September 11 attacks, whose identity was long kept hidden by the US government as a “state secret” whose revelation could cause “significant harm to the national security.” Collusion, foreign adversary, national security: in Washington, it’s all in the eye of the beholder.

Russiagate looks less like a righteous crusade for truth and justice and more like the typical shenanigans for which the FBI and US security state have long been known: prosecutorial overreach, entrapment, and the criminalization of foreign policy dissent.

 

The crux of Russiagate is that it’s a political scandal masquerading as a criminal one.

The interminable scandal has been back in the news this past week thanks to the Trump Department of Justice’s decision to drop charges against Michael Flynn. Flynn was once briefly Trump’s national security advisor before being fired and then charged with lying to the FBI over a phone conversation with Russian Ambassador Sergey Kislyak during the presidential transition. Last Thursday, the House Intelligence Committee finally released fifty-seven transcripts of closed-door interviews it conducted with various key players in the saga over 2017 and 2018, covering Flynn’s call with Kislyak and other matters.

Since the news dropped, every effort has been made to turn Flynn’s absolution into the latest Trump outrage. Barack Obama himself weighed in, charging in a leaked phone call with supporters that “there is no precedent that anybody can find for someone who has been charged with perjury just getting off scot-free,” and that the “rule of law is at risk.”

Four years into this chaotic and reactionary presidency, there are more than enough legitimate Trump scandals to go around. But as with many things Russiagate, both the Flynn case and the release of the transcripts reflect far more poorly on the Obama administration, American’s hallowed national security institutions, and the anti-Trump “Resistance.”

Understanding why requires going all the way back to 2016 and the beginnings of the Flynn case. Flynn was a former intelligence official pushed out of the Obama administration over, among other things, his management style. Years later, he became a characteristically weird Trump guy: a heterodox foreign policy thinker who combined occasional opposition to endless war with conspiratorial Islamophobia, and became nationally known for flirting with the “alt-right” and chanting “Lock her up!” at the 2016 RNC.

Flynn’s loyalty to Trump was rewarded that year when he was announced as the president-elect’s national security advisor. At the same time, Flynn had, like many in Trump’s orbit, been investigated by the FBI over whether he was a Kremlin agent, and only further raised hackles after it was leaked that he had spoken to Kislyak the same day that Obama ordered sanctions and expelled thirty-five Russian embassy officials as retaliation for Russia’s interference in that year’s election.

Flynn was, at first, pushed out by Trump when it turned out he had caused Vice President Mike Pence to unwittingly lie about the contact. He was then later charged by Robert Mueller and his team in the course of the “collusion” probe with lying to the FBI (not, as Obama claimed, perjury), which at the time was cause for much speculation: it was the umpteenth “beginning of the end” of Trump’s presidency but ultimately produced no new revelations about a Trump-Russia conspiracy. Now, he’s been allowed to skip a maximum of five years in jail and walk away “scot-free,” as Obama put it.

But through it all and since, details have trickled out that have made the entire saga far less clear-cut than those most invested in the “collusion” narrative would have the public believe. For one, despite all the innuendo around Flynn’s Russian contacts and his sitting next to Putin at a dinner, investigators found nothing unseemly when looking into Flynn and had all but closedtheir investigation into him when the news about the Kislyak call broke.

Secondly, the charge Flynn was ultimately slapped with, lying to the FBI, now looks more like a case of entrapment. Recently released notes written by Bill Priestep, former FBI counterintelligence director, prior to interviewing Flynn about the Kislyak call suggest the Bureau was looking at the option to “get him to lie, so we can prosecute him or get him fired.” In the notes, Priestep wrote that “I believe we should rethink this,” that simply showing Flynn evidence so he could admit wrongdoing wasn’t “going easy on him” and was routine FBI practice, and that “if we’re seen as playing games, WH [White House] will be furious,” so they should “protect our institution by not playing games.”

What’s more, contemporaneous notes show that the investigators themselves weren’t sure Flynn had intentionally lied to them, and that Comey himself had said so in a March 2017 briefing, before claiming he had never said anything of the sort after being fired by Trump.

There were further improprieties in the investigation. Flynn has claimed, with some evidence, that the FBI pressured him to sit down for the interview without a lawyer. Additionally, two years ago, Comey himself admitted that he had violated protocol by sending investigators to interview Flynn without going through the White House counsel, calling it “something I probably wouldn’t have done or maybe gotten away with in … a more organized administration.”

For nearly a week, Washington has been consumed by reports that Donald Trump pressured Ukrainian President Volodymyr Zelensky to dig up dirt on Democratic frontrunner Joe Biden.

The furor began on Wednesday, Sept. 18, when the Washington Post disclosed that Trump had said something to an unknown foreign leader that “was so alarming that a US intelligence official who had worked at the White House went to the inspector general of the intelligence community.” Two days later, the Wall Street Journal reported that the foreign leader was Zelensky and that Trump had asked him “about eight times” in the course of a single phone conversation to look into allegations that then-Vice President Biden had pushed for the removal of a public prosecutor investigating a Ukrainian company that employed his son, Hunter. A day after that, Biden complained that Trump was trying to “smear me,” while on Sunday, Adam Schiff, Democratic chairman of the House intelligence committee, declared that Trump might be guilty of “the most profound violation of the presidential oath of office … during just about any presidency.”

From initial report to America’s greatest scandal ever in just four days – surely this was some sort of Washington speed record. Since the moment Trump was elected, Democrats have been searching for “the Big One,” as New York Times columnist Maureen Dowd put it, the scandal “that’s going to finally bring Donald Trump down” – and now at last they found it.

Of course, Democrats said the same about Russiagate, the scandal that dominated headlines for two and a half years but fizzled when special prosecutor Robert Mueller said he was unable to come up with evidence “that members of the Trump Campaign conspired or coordinated with the Russian government.” But now that Trump stood accused of conspiring or coordinating with the Ukrainian government – or at least trying to – surely the Big One was finally at hand.

But it’s not. One reason is that there’s no sign of a quid pro quo. The Washington Post suggested in its initial report that the purpose of the July 25 phone call was to “manipulate the Ukrainian government into helping Trump’s reelection campaign.” The means, supposedly, was $250 million in military aid that he was threatening to withhold if the Ukraine failed to cooperate. But the Wall Street Journal’s source specifically denied that Trump had threatened a cut-off while the New York Times reported that a decision to end military aid – subsequently revoked – had actually occurred weeks earlier.

Another reason for skepticism is that charges of a smear job clearly misplaced. If anyone’s activities are suspicious, it’s Biden’s, and Trump can hardly be blamed for wanting to get to the bottom of them.

To briefly recap: in February 2014, a US-backed coup spearheaded by ultra-rightists sent Ukrainian President Viktor Yanukovych fleeing and installed billionaire Petro Poroshenko in his place. This was bad news for a wealthy Yanukovych supporter named Mykola Zlochevsky who was widely accused of corruption and was in danger of losing all or some of his holdings. In an attempt to smooth things over with the Americans, Zlochevsky appointed Hunter Biden to a lucrative post with Burisma Holdings, a natural-gas company he founded in 2002. Hunter had just been discharged from the US Navy after testing positive for cocaine. He had no experience in the natural-gas business and knew nothing about the Ukraine. But he got the job anyway along with a salary of $50,000 a month.

But when the Ukrainian prosecutor general launched an investigation into Burisma, the Obama administration demanded that Viktor Shokin, the man who took over the office a year later, be removed. Indeed, Biden bragged that he threatened to withhold $1 billion in loan guarantees during a visit to Kiev if Poroshenko didn’t do as he was told.

“I said, ‘We’re leaving in six hours,’” he said last year. “If the prosecutor’s not fired, you’re not getting the money. Well, son of a bitch, he got fired.”

If anyone’s guilty of a quid pro quo, it would seem to be Biden.

Questions remain. Washington says it wanted Shokin because he was impeding the Ukraine’s anti-corruption drive and that it pushed for someone more vigorous even though the results for Burisma might have been negative. But the New York Times says the company was pleased by Shokin’s dismissal, and that a year later it was able to reach an amicable settlement with his successor. Hunter Biden’s job was safe.

Democrats Wrote to Ukraine in May 2018, Demanding It Investigate Trump | Breitbart

Democrats wrote to the Ukrainian government in May 2018 urging it to continue investigations into President Donald Trump’s alleged collusion with Russia in the 2016 presidential campaign — collusion later found not to exist.

The demand, which came from U.S. Senators Robert Menendez (D-NJ), Dick Durbin (D-IL), and Patrick Leahy (D-VT), resurfaced Wednesday in an opinion piece written by conservative Marc Thiessen in the Washington Post.

Ironically, Speaker of the House Nancy Pelosi (D-CA) declared Tuesday that the mere possibility that President Trump had asked Ukraine to continue an investigation of former Vice President Joe Biden — even without a quid pro quo — was enough to trigger an impeachment inquiry. (Biden boasted in 2018 that he had forced Ukraine to remove its prosecutor by threatening to withhold $1 billion in U.S. aid; he did not tell his audience at the Council on Foreign Relations that the prosecutor was looking into a firm on whose board his son, Hunter Biden, was serving.)

It got almost no attention, but in May [2018], CNN reported that Sens. Robert Menendez (D-N.J.), Richard J. Durbin (D-Ill.) and Patrick J. Leahy (D-Vt.) wrote a letter to Ukraine’s prosecutor general, Yuriy Lutsenko, expressing concern at the closing of four investigations they said were critical to the Mueller probe. In the letter, they implied that their support for U.S. assistance to Ukraine was at stake. Describing themselves as “strong advocates for a robust and close relationship with Ukraine,” the Democratic senators declared, “We have supported [the] capacity-building process and are disappointed that some in Kyiv appear to have cast aside these [democratic] principles to avoid the ire of President Trump,” before demanding Lutsenko “reverse course and halt any efforts to impede cooperation with this important investigation.”

The Democrats’ letter is available online here. In it, Menendez, Durbin, and Leahy demanded that the Ukrainian government answer their questions about the Mueller probe, and issued an implied threat: “This reported refusal to cooperate with the Mueller probe also sends a worrying signal — to the Ukrainian people as well as the international community — about your government’s commitment more broadly to support justice and the rule of law.”

(Natural News) For nearly two years as information about the coup attempt against President Donald Trump known as “Spygate” dripped out, observers long suspected that an operation of this scope – involving the Justice Department, the FBI, U.S. and foreign intelligence assets – had to have come from the very top.

That is, former President Obama, who was in the Oval Office when Spygate was hatched and began as the 2016 presidential election cycle kicked off, had to have not only known about it but approved it.

Now, the speculation is over: Of course, he did.

Earlier this week during an interview with Fox News’ Sean Hannity, Andrew McCarthy, attorney and former federal prosecutor who specialized in national security cases, said “counterintelligence operations” which is what Spygate was, at its core, are “done for the president.”

That means, as The Gateway Pundit notes, they are executed specifically to inform the commander-in-chief.

“What I’m saying is not that the president sits there and directs that there be counter-intelligence investigations. What I’m saying is that unlike criminal investigations, counter intelligence investigations are done for the president,” McCarthy said.

“The only reason to do them is for the president with the information he needs to protect the United States from foreign threats. They’re not like criminal investigations in that regard. So, in principle, the information is for the president. And here we know at various junctures we have actual factual information that this investigation was well known to President Obama,” he added.

Hannity asked if the president knew about the investigation from the outset, wouldn’t he have been updated on its progress?

“Sean, if things were working properly the president should have been alerted about it and informed. It was a very important investigation,” McCarthy added.

“If they actually believed what they were telling the court that it was a possibility that Donald Trump was actually a plant of the Kremlin, it would have been derelict on their part not to keep the president informed,” he added. Assumptions have been confirmed

This isn’t the first crumb of evidence indicating that Obama was in on Spygate from the outset. In fact, previous information indicates that Obama actually orchestrated the coup attempt.

As The National Sentinel reported in May 2018, former Bush White House spokesman Ari Fleischer said during a Fox News interview that there was no way Obama would not have been kept in the loop.

Investigative reporter Paul Sperry tweeted the information: “BREAKING: Bush press secretary Ari Fleischer said “I guarantee the answer is yes” to whether Obama knew Halper & others were deployed to spy on Trump campaign. Fleischer explained that no FBI director would put informants inside a presidential campaign w/o the prez authorizing it.”

Earlier that same week, President Trump pretty much said the same thing – and he should know, since he now occupies the Oval Office.

“Would he know? I would certainly hope not. But I think it’s going to be pretty obvious after awhile,” POTUS teased in response to a question from a reporter.

There’s more.

As The National Sentinel noted further, then-FBI counterintelligence official Peter Strzok, in a text to his lover, then-FBI lawyer Lisa Page, discussed the preparation of talking points for then-FBI Director James Comey to give to President Obama. Page said it was important to do so because “potus wants to know everything we’re doing.”

Also, since the spying against Team Trump was set up as a counterintelligence operation, Obama would have been updated regularly via the President’s Daily Intelligence Brief.

It’s one thing to have assumed that former President Obama was in on the Spygate scandal from the outset. But it’s another to now have had that assumption verified and confirmed.

The question is, will he ever be held accountable for his role?

Blithering Idiots Express Fear That Putin Will Rig 2020 Election For Trump – Caitlin Johnstone

“Putin” is the number one USA trend on Twitter as of this writing, which is always a reliable sign that something very stupid is happening in American media.

“Putin” is once again the hysterical shrieking buzzword of the day because Donald Trump openly boasted at a press conference of having had an hour-long phone call with the Russian president, in which he claims the two leaders discussed nuclear de-escalation, Venezuela, North Korea, and the discredited “collusion” narrative. When asked whether he’d told Putin not to meddle in the 2020 US elections, Trump replied, “We didn’t discuss that.”

“Had a long and very good conversation with President Putin of Russia,” the president tweeted. “As I have always said, long before the Witch Hunt started, getting along with Russia, China, and everyone is a good thing, not a bad thing. We discussed Trade, Venezuela, Ukraine, North Korea, Nuclear Arms Control and even the ‘Russian Hoax.’ Very productive talk!”

So of course everyone is now in garment-rending apocalyptic DEFCON 1 catastrophe mode.

“It bears repeating: We have been given no indication that Trump or his re-election campaign will hesitate to take advantage of Russian help again in 2020, in whatever form it might take,” warned the Wall Street Journal’s Dustin Volz.

“President Trump today continues to belittle Russian election interference in the 2016 presidential election, as well as continued election interference,” CNN’s Jake Tapper solemnly warned today. “The president went on to tell reporters later that he did not tell Putin to stop engaging in election interference which remains, according to Trump’s own top national security officials, a continuing threat to the United States. Based on the president’s public statements, and apparently his private one with Vladimir Putin, the man who led and continues to lead cyber-attacks on the United States, the president’s more concerned with underlining that Special Counsel Robert Mueller was unable to find sufficient evidence that any member of his team was involved in criminal conspiracy with Russia.”

“The simple fact is this: Trump remains — despite all available evidence — a skeptic about both Russia’s past attempts at interference in the 2016 election and, therefore, the country’s attempts to target future elections,” warns CNN’s Cris Cillizza. “That skepticism could have far reaching consequences when it comes to just how much (or little) the administration prioritizes dealing with these threats from foreign powers heading into the 2020 election. And that is a truly scary reality.”

“The 2020 campaign is already in full swing and Trump just told Putin, the man behind the most serious cyber attack on our democracy ever, that he believes it was all a hoax,” tweeted Congressman and virulent Russiagater Adam Schiff. “Once again, he betrays our national security and for what? Nothing more than his own vanity and delusion.”

“Exactly what Putin wanted and expected,” tweeted MSNBC’s Clint Watts. “This is why Russia backed Trump, elevate politicians to achieve what Russia wants – to subvert and weaken democracy, surrender the world to authoritarians, like the Kremlin.”

So the narrative in mainstream liberal circles today is that Putin is going to interfere in the 2020 elections, and, because that interference will surely advantage Trump, there will be no resistance to that interference.

Only blithering idiots believe this narrative.

To begin with, the public has still seen not one single shred of evidence that Russians interfered in the 2016 election in any meaningful way, and, in a post-Iraq invasion world, only idiots believe on faith the unsubstantiated claims made by government agencies about rival governments. We’ve seen the Mueller report cited as “evidence” of this interference, but the Mueller report contains nothing but assertions, and assertions are not evidence. People have tried to argue with me that Mueller would never make assertions about Russian interference without having seen copious amounts of hard, verifiable evidence, but that is exactly what Mueller did with WMDs as FBI Director in February 2003. Daniel Lazare for Consortium News documents that there are in fact some major plot holes in Mueller’s timeline, making it entirely possible that a bogus narrative is being advanced.

So there’s no reason to accept on faith that Russian election interference happened in 2016, let alone that there’s any risk of it happening in 2020. But even if you do accept the establishment Russia narrative regarding 2016, you can be certain that Moscow won’t be interfering in 2020 for Trump’s benefit.

You can be absolutely certain that Russia won’t be interfering to re-elect Trump because Trump has proven to be the most hawkish president against Russia since the fall of the Soviet Union, by a very wide margin. For all his rhetoric about “getting along with Russia”, Trump has greatly escalated tensions with the nuclear superpower by staging a coup in Venezuela, implementing a Nuclear Posture Review with a much more aggressive stance against Russia, withdrawing from the INF treaty, bombing and illegally occupying Syria, arming Ukraine, and many, many other hawkish actions taken against the interests of the Russian Federation which his predecessor Obama never dared to take.

Even if Putin were the brilliant omnipotent mastermind with tentacles in every international affair as he is consistently depicted in western mainstream media, it would make no sense whatsoever for him to help re-elect an administration that has been undermining and threatening Russia at every opportunity. That will not happen.

But of course, this obvious fact will not stop the Russia conspiracy theories, because Russia conspiracy theories have nothing to do with facts. We can expect to see fact-free allegations that Russia is planning to help Trump win in 2020 getting louder and louder as the election grows nearer. We can expect to see these fact-free allegations bolstered and amplified by western government agencies who need to manufacture support for further escalations against Russia, by the mass media who need ratings, and by the Democratic Party who need to keep their base fixated on insubstantial nonsense while they force an establishment loyalist through their fake primary.

It’s so interesting how each mainstream side of this is doing exactly the opposite of what they claim to be doing: Trump claims to want to work with Russia, but in term of action his administration is attacking Russia’s interests in many hugely significant ways to an extent that is unprecedented in a post-USSR world. Democrats claim to be opposing Trump’s pernicious inclinations, but in practice they fully support all his most pernicious agendas, including the potentially world-ending escalations between two nuclear powers, and including the Venezuela regime change operation which is getting more aggressive by the day. Even the supposedly progressive wing of the Democratic Party has been mostly flowing along with this, with Alexandria Occasio-Cortez reportedly saying “I defer to caucus leadership on how we navigate this” when questioned on Trump’s Venezuela coup attempt.

The gap between reality and the dominant narratives about reality is getting wider and wider. Something’s going to have to give.

The long history of US-Russian ‘meddling’ (by Stephen Cohen) — RT Op-ed

The two governments have repeatedly interfered in each other’s domestic politics during the past 100 years – and it’s not all bad.

Even though the bipartisan Senate Intelligence Committee found “no direct evidence of a conspiracy between the Trump campaign and Russia,” Russiagate allegations of “collusion” between candidate and then President Donald Trump and the Kremlin have poisoned American politics for nearly three years.  They are likely to continue to do so for the foreseeable future, and due not only to the current subpoena-happy Democratic chairs of House “investigative” committees.

At the core of the Russiagate narrative is the allegation that the Kremlin “meddled” in the 2016 US presidential election. The word “meddle” is nebulous and could mean most anything, but Russiagate zealots deploy it in the most ominous ways, as a war-like “attack on America,” a kind of “Pearl Harbor.” They also imply that such meddling is unprecedented when in fact both the United States and Russia have interfered repeatedly in the other’s internal politics, in one way or another, certainly since the 1917 Russian Revolution.

 

For context, recall that such meddling is an integral part of Cold War and that there have been three Cold Wars between America and Russia during the past one hundred years. The first was from 1917 to 1933, when Washington did not even formally recognize the new Soviet government in Moscow. The second is, of course, the best known, the forty-year Cold War from about 1948 to 1988, when the US and Soviet leaders, Ronald Reagan and Mikhail Gorbachev, declared it over. And then, by my reckoning, the new, ongoing Cold War began in the late 1990s, when the Clinton administration initiated the expansion of NATO towards Russia’s borders and bombed Moscow’s longtime Slav and political ally Serbia.

That’s approximately eighty-five years of US-Russian Cold War in a hundred years of relations and, not surprisingly, a lot of meddling on both sides, even leaving aside espionage and spies. The meddling has taken various forms….

It’s nice Bill Kristol and Hillary have so much in common. They are different sides of the neocon/warparty coin. They are for anything that keeps peace from breaking out and forcing McDonnell Douglass employees from finding real, constructive jobs. Buchanan points out one thing we already knew-the integrity of James Comey and the FIB leave something to be desired.
