Biden Administration Set To Appeal Ruling That Lifted Mask Mandate For Travel

And the winner of the most ironic sentence of the day goes to White House spokesperson Jen Psaki, who after relying on court ruling after court ruling to enforce varying levels of health tyranny for the last 15 months, uttered the following in her out-loud voice…

“Public health decisions shouldn’t be made by the courts. They should be made by public health experts.”

Can you smell the fear?

In a stunning move – soon to be filed under the “completely lost touch with America” folder – the Biden administration is reportedly planning to appeal the ruling that lifted the COVID mask mandate on travel, just hours after most major airlines and airports (and ground transportation) has dropped their mask rules.

It was evident this was coming earlier in the day after White House spokesperson Jen Psaki warned and Xavier Becerra, Biden’s health secretary, told reporters in Nevada, that “we are right now in the process of deciding, and we likely will appeal that ruling, but stay tuned.”

Jonathan Turley offered some insight before the actual decision was made to appeal if CDC thinks it necessary:

The Administration is going to have a hard time making this cat walks backwards. The cheering of passengers and pilots seemed as much as a communication to the Administration as it was a celebration.  A large number of airlines immediately declared the mandate to be dead and unenforceable. It is like throwing a retirement party for an employee before they have decided to go. It is a tad awkward to express doubts when someone is showing you the door.

That is why those cheering videos could have a greater impact on the White House than any CDC or DOJ recommendation. The Biden Administration could still appeal as it has in past such cases.  There will certainly be many DOJ lawyers asserting that they could win on appeal on the basis of agency deference. The question is who would tell the public. They may have to wait for the “ding, dong” parties to end.

But, given all that, they decided it was worth it…

In a decision that will likely be welcomed by many New York parents and schoolchildren, along with the countless workers, consumers and tourists in the Empire State, the Supreme Court of New York struck down Gov. Kathy Hochul’s statewide mask mandate. In its ruling, the court declared the mask mandate “unconstitutional” and “null, void and unenforceable”.New York State Supreme Court Justice Thomas Rademaker of Nassau County wrote in his opinion explaining the decision that the governor doesn’t have the authority to impose the mandate since the “emergency powers” once wielded by her predecessor, Gov. Andrew Cuomo, are no longer in place.Without the assent of the legislature, the Court determined that the governor doesn’t have the ability to order masks mandates, although the circumstances would be different if emergency powers granted by lawmakers were still in effect.

Gov. HochulThe ruling goes: “While the intentions of Commissioner Bassett and Governor Hochul appear to be well-aimed squarely at doing what they believe is right to protect the citizens of New York State, they must take their case to the State Legislature.”Gov. Hochul ordered the mandate last month amid a flurry of new restrictions ordered by various states. President Biden has seen SCOTUS and another federal judge overrule his vaccination mandates.In response to the ruling, Gov. Hochul said the following: “My responsibility as Governor is to protect New Yorkers throughout this public health crisis, and these measures help prevent the spread of COVID-19 and save lives. We strongly disagree with this ruling, and we are pursuing every option to reverse this immediately.”Put another way, Gov. Hochul says she doesn’t care about the legal precedent, and will do everything in her power to continue enforcing the mandate.

CDC Credibility Implosion: New Mask Mandate Makes No Sense

Even much of the mainstream media is confused and frustrated by yesterday’s sudden flip-flop by the CDC, advising that everyone once again begin wearing masks indoors. They claimed it was because the “delta” variant was eluding the vaccine, while at the same time continuing to claim that the vaccine was very effective and that everyone should take it. Both of these things cannot be true…and most Americans understand that. Will the push-back on this incomprehensible policy-shift gain momentum?

CDC head Rochelle P. Walensky says the variant is eluding the vaccine so the answer to take more of the vaccine. Walenski is the Yellen (ie a simpleton) of the CDC.

What the deceptive doc leaves out of his screed was that in the meantime the Texas governor “listened to the science” and imposed a statewide mask mandate in July that was obeyed by a very high percentage of the population. Masks would “limit the spread” of the virus, we were told. So everyone wore them.

But they actually did nothing to “slow the spread” of the virus.

Dear Friends:

I was interviewed on RT America’s “In Question” program about today’s lifting of the mask mandate and other Covid-related restrictions in Texas. The usual suspects – those who have made a political and monetary fortune from the year of fear-induced compliance with the most insane and destructive government edicts – are so livid at Texas Governor Gregg Abbott that it’s getting hard to maintain the previous level of enmity we have held toward him over the past year for shutting down in the first place.

With enemies like these…

CNN ran a deceptive editorial claiming that Governor Abbott’s decision to end the state-enforced mask mandate was indicative of his “delusional” view of the virus. The author, a medical doctor called Jonathan Reiner, attacked Abbott’s “premature” limited opening last April as cases began to fall. Lifting the “stay-at-home” order was tragically wrong for Texas, wrote Reiner, because come November the cases were skyrocketing again!

What the deceptive doc leaves out of his screed was that in the meantime the Texas governor “listened to the science” and imposed a statewide mask mandate in July that was obeyed by a very high percentage of the population. Masks would “limit the spread” of the virus, we were told. So everyone wore them.

But they actually did nothing to “slow the spread” of the virus. 

There is no doubt that CNN’s doctor/author enthusiastically supported the wearing of face masks to halt the spread of Covid, so how does he explain the huge winter seasonal spike in virus infections in Texas? Funny, he doesn’t mention it.

Likewise, when CNN’s Dr. Reiner attacks Abbott for “allowing” indoor dining and the opening of bars (at limited capacity) he cites the most recent CDC report detailing a year-long study of the effectiveness of mask mandates and restaurant closures. 

Writes Reiner, “This week, the CDC published a report of the effect of mask mandates and indoor restaurant dining. The researchers found that mandating masks was associated with a decrease in daily Covid-19 case and death growth rates within 20 days of implementation. In-restaurant dining was associated with an increase in daily Covid-19 case and death rates.”

Uh…yeah. But that’s only a very small and highly-edited part of the story. In fact, the CDC report is a bombshell – which you can bet will be hidden from all in the mainstream media – because it shows the exact opposite!

The “decrease” in cases and deaths where mask mandates were in place and restaurants were forcibly closed by authoritarian officials was statistically INSIGNIFICANT!

If such measures worked we might expect to see a significant if not massive reduction in new cases and deaths where mask mandates and restaurant closures were put in place. In fact the reduction was an infinitesimal 1.32% on average! 

Compare that to all the damage done by forced masks and forced business closures! Suicides.

As the CDC itself wrote on its report, the mask mandates DO NOT slow the virus spread, full stop, but rather ““have the potential to slow the spread of COVID-19. . .”

Only the “potential.” How reassuring. Science!

Likewise, the year-long CDC study itself concluded, “[d]uring the study period, states allowed restaurants to reopen for on-premises dining in 3,076 (97.9%) U.S. counties. Changes in daily COVID-19 case and death growth rates were not statistically significant 1–20 and 21–40 days after restrictions were lifted.”

Gee, thanks for destroying the life’s work and life savings of hundreds of thousands of restaurants for a result that was “not statistically significant.”

Of course for Fauci and the CDC and the rest of the medical-tyranny complex, none of us are “statistically significant” so they have run rough-shod over this country without shame for the past year.

Still, it is hard to not conclude that Abbott’s move, weak as it is and with way too many small-print details, has caused a massive short-circuiting in Sauron’s previously unimpeded advance.

Texas, the largest and most dynamic state in the US, has all but abandoned Fauci and the fear-mongers. Has strayed off the reservation. Has dared join South Dakota’s Kristi Noem and Florida’s Ron DiSantis. This is a death blow to the tyranny regime. 

Fauci was interviewed, looking as if he’d ingested a can of botulism-ridden tuna, warning that Abbott was “putting aside all public health measures” in a move that was “quite risky.”

Much of the opprobrium Abbott has earned with his sudden decision to “open” Texas could have been easily avoided. Had he stood on principle from the beginning he would not have had to constantly explain his seeming shifting with the winds.

For example, if Abbott had any philosophical grounding beyond desire for higher office. he could have taken the Ron Paul path and simply stood for principle, in the face of ridicule and attack. If he had from the beginning, as did South Dakota Governor Kristi Noem, simply stated that he does not have the moral or legal authority to close businesses down, to pick who is “essential” and who is “non-essential,” he would not have had to endlessly explain his flip-flops to the hostile media.

He could have explained his steadfast position in the context of a philosophy grounded in liberty.

But he did not, and it appears at this time that such moral weakness has brought about the end of his political career. Ron Paul has always said, politics is so much easier if you actually have a philosophy based on liberty and you stand by it. 

Nevertheless, the “fall” of Texas from the constellation of the Covidian Cult may well be a death blow to the miserable year of public health tyranny. My unscientific survey of Lake Jackson and Brazoria in this first day of post-mask mandate did not reveal a dramatic tilt toward liberty. But still the first chink chink chinking away at the Berlin Wall were also relatively insignificant. But liberty was then, as now, an idea whose time had come.

There is a feeling of the fall of the Berlin Wall of virus tyranny. But many are left questioning: why the authoritarian over-reach in the first place? Will Abbott be punished politically?

Joe Biden’s Mask Mandate Is Only The Beginning – Issues & Insights

At a briefing on Thursday, Joe Biden called for a nationwide mask-wearing mandate “for the next three months at a minimum.” Never mind that such a federal mandate is likely unconstitutional, this is just one of a multitude of areas where Biden, and his running mate Kamala Harris, want to impose the federal government on even the most mundane of actions by Americans.

It is surely worth noting, especially by those who claim to value liberty, that Biden and Harris eagerly desire to take much of it away, always in the name of some greater good. Indeed, over the course of their campaigns, the two have proposed either to outlaw or force so many things there’s not enough room to list them all here.

So, as a reader service, we’ve gathered up a sampling of things they say they want to either ban or mandate should they gain access to the White House.

Bans

Plastic straws: When Harris was asked at a town hall whether the federal government should ban plastic straws, her answer was, “I think we should, yes.” Biden didn’t go that far, but did say that “I don’t think we should be using plastic straws anymore.”

Plastic bags: Biden did, however, say he favored a ban on plastic grocery bags. “I agree with you, 100%,” Biden told a woman at a campaign stop. “We should not be allowing plastic. What we should do is phasing it out.”

Gas-powered cars: Biden pledges that he will impose fuel economy mandates that will “ensure” 100% electric cars. Harris, meanwhile, was a co-sponsor of The Zero-Emission Vehicles Act, which would outlaw the sale of new gas-powered cars starting in 2040.

The death penalty: Biden used to support the death penalty, but flipped so he could appeal to his party’s left wing. Now he says that “Because we can’t ensure that we get these cases right every time, we must eliminate the death penalty.” Many Democratic presidential candidates echoed the same message.

Private prisons: Biden promises to “end the federal government’s use of private prisons,” says his campaign website, “And he will make clear that the federal government should not use private facilities for any detention, including detention of undocumented immigrants.”

New oil and gas leases on federal lands and offshore: In a March debate, Biden promised that if elected there would be “no more drilling on federal lands, no more drilling, including offshore, no ability for the oil industry to continue to drill, period, ends, number one.” Later his campaign said he meant only to ban new permits.

Fracking: Biden has tried to straddle the fracking issue, but Harris said during her primary campaign that she supports an outright prohibition. “There is no question I am in favor of banning fracking.”

“Assault” Rifles. Both Biden and Harris promise to ban so-called assault rifles such as the AR-15, but Harris went much further. She promised that if elected she would impose a mandatory buyback program. “We have to work out the details — there are a lot of details — but I do” support a forced buyback, Harris said. “We have to take those guns off the streets.” The Washington Examiner reported last August that Harris was even open to the idea of sending the police into homes to confiscate guns.

Right-to-work laws: In a sop to their union benefactors, both Biden and Harris promise to overturn the right-to-work laws in effect in 28 states. Harris said the president needs “to speak up about the need and the right workers have to be able to organize and fight for their rights … It has to be about banning right-to-work laws”.

Trump from Twitter: Harris pushed Twitter to ban President Donald Trump from Twitter. “Twitter should be held accountable and shut down that site,” Harris said during one of the Democrats’ debates.

Social media hate speech: Harris also wants to ban “hate speech” on social media. ”We will hold social media platforms accountable for the hate infiltrating their platforms because they have a responsibility to help fight against this threat to our democracy,” Harris said during her campaign.

Private health insurance: During the campaign, Harris said she favored a ban on private insurance, then retreated somewhat. The health plan she eventually released would have ended up putting private insurance out of business. Biden says he wants to “build on ObamaCare,” but his “public option” would also result in the eventual destruction of private insurance.

Mandates

Masks: Biden hasn’t specified how he’d enforce a nationwide a requirement to wear masks, or explained how it could be constitutional. As James Phillips and John Yoo pointed out, “There is nothing that authorizes a President Trump now, or a President Biden tomorrow, to mandate face coverings nationwide via executive power. Congress has not enacted any such law for the president to enforce. Masks do not fall under the president’s power as commander in chief, nor do they plausibly come within any of his other executive authorities, such as granting pardons or nominating officers.”

Government-approved insurance: Biden promises that he will reimpose the hated ObamaCare individual mandate — along with the mandate tax — to buy government-approved insurance.

$15 minimum wage: Biden and Harris both endorse this, despite the adverse impact it will have on jobs.

Equal Pay: “Equal pay for equal work. It’s common sense. It’s also overdue. Let’s close the gap & let’s do it now,” Biden tweeted.

Six months paid parental leave: Harris proposed this during her campaign, saying that “Guaranteeing six months of paid leave will bring us closer to economic justice for workers and ensures newborn children or children who are sick can get the care they need from a parent without thrusting the family into upheaval,”

A third Federal Reserve mandate: Little noticed has been Biden’s promise to add a third mandate to the Federal Reserve’s charter, (which already has one mandate too many). In addition to containing inflation and maximizing employment, Biden would have the central bank  “aggressively target persistent racial gaps in job, wages, and wealth.” The Wall Street Journal called it “a promise to politicize the Federal Reserve in a whole new way.”

The bottom line is that if you cherish freedom, you will get a lot less of it in a Biden-Harris administration. However, if you like the federal government bossing you around in every corner of your lives, then they are the candidates for you.
